Change of your details

You must let us know within 7 days if you have changed address or name.

Decline any application

All lending is subject to status, availability and our lending criteria. The right to decline any application is reserved.

You Agree

  1. To pay the installments and that if you persistently fail to make payments as required under the Agreement that we may declare a default which we may report to credit reference agencies
  2. That if there are two or more borrowers under this Agreement that each of You is jointly and severally liable for the entire debt under this Agreement
  3. That you received, read and understood the Pre Contract Information supplied to you prior to execution of this Agreement
  4. All notices, statements and other communications from Us to You shall be considered validly if posted by Us to your last known address and deemed received 2 working days following posting
  5. That we may use your personal data as detailed below and that we may report information as to your performance under this Agreement periodically to Credit Reference Agencies detailed below
  6. That we may transfer our rights and obligations under this Agreement to a third party

You May

Ask us to receive payment from someone other than yourself, either at your address or from the home of the person making the payment on your behalf.

Data Protection

In accordance with standard lending policy we will verify and credit check your application and shall be entitled to make further checks and seek further verifications from time to time throughout the life of this Agreement. This will involve the search of records held by credit reference and fraud prevention agencies. Such agencies not only provide credit and voters roll information, they can verify your identity and also record the details of searches including whether or not your application proceeds. If false or inaccurate information is provided and fraud is identified, details will be passed to fraud prevention agencies. Law enforcement agencies may access and use this information.

Use of Your Personal Information

Information about all applicants will be collected and held on our systems and database and will be used throughout the life of this Agreement to process your application and for ongoing account maintenance, administrative purposes and regulatory reporting to the FCA. It will be held in accordance with the Data Protection Act 1998 EU General Data Protection Regulation 2018 (“GDPR”).  We will only disclose it to our lawyers, auditors, external advisors, agents, credit reference agencies, where required by as well as to anyone to whom We transfer our rights and duties under this Agreement

Governing Law

If your residential address as detailed in this Agreement is in Scotland then this Agreement and all claims and disputes between the parties to this Agreement arising out of or in connection with this Agreement shall be governed by and construed in accordance with Scottish law. The courts of Scotland shall have exclusive jurisdiction to determine any disputes arising out of or in connection with this Agreement and the parties to this Agreement submit to the exclusive jurisdiction of the courts of Scotland in relation to all disputes

If your residential address as detailed in this Agreement is outside of Scotland then this Agreement and all claims and disputes between the parties to this Agreement arising out of or in connection with this Agreement shall be governed by and construed in accordance with English law. The courts of England shall have exclusive jurisdiction to determine any disputes arising out of or in connection with this Agreement and the parties to this Agreement submit to the exclusive jurisdiction of the courts of England in relation to all disputes
